Texas does not have a state income tax for both individuals and businesses. Texas does levy a franchise tax on entities formed in Texas or doing business in Texas.
Texas Franchise Return General Information
Electronic filing - Texas allows electronic filing for Franchise Tax Returns. Texas supports electronically filing the current year and two prior years.
Due Date for Texas Franchise Tax Return - May 15, except for entities no longer doing business in Texas whose final report is due 60 days after they no longer have sufficient nexus with Texas.
Franchise Tax Return Extension - The Comptroller’s office will grant an extension of time to file a franchise tax report upon receipt of a timely request. Timely means submitted or postmarked on or before the due date of the original report. Generally, for an extension to be valid, 100 percent of the tax paid in the prior year, or 90 percent of the tax that will be due with the current year’s report, must be paid on or before the original due date of the report. The length of the extension varies depending on the entity:
- Entities not required to pay franchise tax by EFT: 6 months.
- First extension for entities required to pay franchise tax by EFT: 3 months.
- Second extension for entities required to pay franchise tax by EFT: 3 additional months.
- Final report: 45 additional days past the final report due date.

Amended Franchise Tax Return - The amended return can be e-filed or mailed.
WebFile Number - Each taxpayer and tax type is assigned a WebFile Number, and this number must be included in the franchise tax return. Register at Texas Comptroller eSystems and get more info here.
